This site is owned and operated by Dermatic Ltd (incorporated in England, Company Registration Number: 08475464) (“We”, “us” and “our”). Our company’s nature of business includes, inter alia, other human health activities. We provide you with our service through our qualified dermatologists.

Service Description

Our service enables you to submit images of your moles alongside relevant medical history for each lesion for assessment by our dermatologists. Our dermatologists will provide you with an indicative diagnosis and treatment recommendations based on the information and images you provide.

When using our services, we define “indicative diagnosis” as a preliminary or tentative diagnosis based on the images and information you provide in a virtual setting. It might differ
from a “definitive diagnosis” which can be achieved by an in-person physical examination conducted by a trained dermatologist when more information is present and the quality of the equipment and images is better.

Indicative diagnosis serves as an indicator for what the issue might be, guiding the healthcare provider in planning further diagnostic tests or treatments if recommended.

OUR SERVICE IS NOT A SUBSTITUTE FOR A PHYSICAL EXAMINATION BY A QUALIFIED DERMATOLOGIST, ESPECIALLY FOR HIGH-RISK, HIGH MOLE-COUNT PATIENTS.

Arranging a physical examination by a qualified dermatologist upon our indicative diagnosis is solely your responsibility.

Our online mole check service is available to patients around the world. However, please note that our medical professionals are licensed in the United Kingdom, and their medical opinions may not have the same legal standing in countries where their licenses are not recognized. Our malpractice insurance provides coverage for our services worldwide, but liability risks and implications may vary by country.

Registration and Payment

To use our service, you must register an account on our website under https://onlinemolecheck.com/ (the “Website”) and pay the fee for our service. The applicable service fees are indicated on the Website.

You must provide accurate and complete information when registering for our service. We hereby expressly exclude any liability that arises from or in connection with the provision of inaccurate or incorrect data.

Submission of Images

You shall submit images of your moles through our Website. By submitting images and the required information, you consent that our people can access and examine the images and the information.

The way the images are made shall be in line with the instructions provided on the Website, otherwise we may not be able to provide you with an indicative diagnosis, or the indicative diagnosis would be misleading. The provision of images that are in line with our instructions and are therefore suitable for medical examination is solely your responsibility. Notwithstanding this, we may request new images if we find it necessary. We hereby expressly exclude any liability that arises from or in connection with the provision of images that cannot be properly assessed by our dermatologists.

By submitting images, you agree and declare that the images are accurate and complete and that you have the right to submit the images for assessment.

If you submit images on behalf of a third party (e.g. family member), you have to have the consent of the person to do so. Upon our request, you shall be able to prove that you submitted the images with such third party’s consent.

We retain your submitted images for a period of 10 years or as required by law, after which they will be securely deleted.

Assessment by Dermatologists

Our dermatologists will assess the images you submit within 5 working days from the day the images are submitted and the service fees is paid and provide an indicative diagnosis and treatment recommendations based on the information provided by you. Our dermatologists may request additional information or images to provide an accurate indicative diagnosis and treatment recommendations.

If we already assessed images of your mole before, in case you submit an image of the same mole at a later time (due to a perceived change or because our dermatologist recommended a follow-up) as a follow-up to the previous image, the new image will be compared with the previous one(s). Based on this comparative analysis, we will provide an indicative diagnosis and recommendations.

Our dermatologist may refuse the assessment of one or all of your submitted images if the quality is inadequate or the case is too complex for online assessment.

We will provide you with a written indicative diagnosis on the basis of our assessment, however, such indicative diagnosis may not be equivalent to the diagnosis that is made in the course of a physical examination by a qualified dermatologist.

Limitations of Service

OUR SERVICE IS NOT A SUBSTITUTE FOR A PHYSICAL EXAMINATION BY A QUALIFIED DERMATOLOGIST. OUR INDICATIVE DIAGNOSIS AND TREATMENT RECOMMENDATIONS ARE BASED ON THE INFORMATION AND IMAGES YOU PROVIDE AND MAY NOT BE ACCURATE OR COMPLETE.

While our dermatologists have extensive experience in evaluating moles and identifying potential issues, the accuracy of the assessment may be limited by the quality of the images and the inherent limitations of remote examinations.

Intellectual Property

The content on our Website, including images, text, and graphics, is our intellectual property and may not be used without our permission.

The content on our Website, including but not limited to images, text, graphics, logos, icons, and software, is our property or the property of our licensors and is protected by international copyright laws. Unauthorized use of this intellectual property is prohibited.

Examples of unauthorized use include, but are not limited to:
– Reproducing, copying, distributing, or publicly displaying any of the content on our Website without our express written permission.
– Modifying, adapting, sub-licensing, translating, selling, reverse engineering, decompiling or disassembling any portion of our Website or its content.
– Using our Website content for any commercial purpose not expressly permitted by us in writing.
– Removing any copyright, trademark, or other proprietary rights notices contained on our Website.

Violation of our intellectual property rights may result in legal action taken against the offender.

Limitation of Liability

We may decline the evaluation of a case if the image quality is insufficient or the case is overly complex, necessitating an in-person medical assessment instead. By doing so, we aim to reduce the risks associated with our online mole check service.

To the fullest extent permitted by applicable laws, our liability to you shall not exceed the service fee you paid for our services (if any). We shall not be liable for any damages, including direct, indirect, incidental, punitive, or consequential damages, arising from the use of our service, except where such limitations of liability are not allowed under the laws of England and Wales.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the services.

Refund Policy

We offer a clear and fair refund policy to ensure your satisfaction with our services. Below are the scenarios under which a refund may be issued:
– If our dermatologist refuses to assess one, some, or all of your images due to inadequate quality or the complexity of the case, a full refund will be provided.
– If there are issues with the image quality, you have one free-of-charge option to submit new, better-quality images. If the resubmitted images are still inadequate for assessment, a partial refund will be provided, with £10 withheld as an administration fee.
– If you are not satisfied with our service, you may request a refund within 5 (five) days of receiving our indicative diagnosis. You will need to provide detailed reasons for your dissatisfaction, which will be assessed on an individual basis. We will determine at our sole discretion whether to issue a full or partial refund.

Please note the following:
– Refund requests must be submitted through email to our customer service at refund@onlinemolecheck.com.
– Refunds will be processed within 10 (ten) working days upon approval.
– Refunds will be issued to the original payment method used during the transaction.
– In case of a refund, we will provide a confirmation and the transaction details via email.

We aim to maintain transparency and fairness in our refund process to ensure a positive experience with our online mole check service.

Complaints Policy

At OnlineMoleCheck.com, we are committed to delivering high-quality healthcare services. We understand that there may be times when patients wish to express dissatisfaction with our services. Our complaints policy ensures that all feedback and complaints are taken seriously and handled promptly and confidentially. Each complaint is acknowledged within three working days and thoroughly investigated. We guarantee that raising a complaint will never result in discrimination or affect the quality of care received. Termination

We may terminate your account and access to our service at any time if you violate these Terms. You can also terminate your account any time, however, if an examination is in process at the time of the termination of the account, the service fee will not be refunded.

Governing Law

Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
